TERMS OF SERVICE AND SALE

Article 1. Preamble
These terms of service and sale (the "Terms") govern access to the Nanou Studio service (the "Service"), available via nanou.studio and our iOS and Android apps, as well as any associated subscriptions and purchases.
The Service is operated by JL CAPITAL, a single-member limited liability company (EURL) with share capital of €1,000, registered with the Bordeaux trade register under number 993 098 920, with registered office at 3 Place Léon Duguit, 33800 Bordeaux, France (the "Publisher", "we" or "us"). Article 2. Acceptance and enforceability
Signing up or subscribing constitutes full and unconditional acceptance of these Terms by the user ("you"). If you do not accept these Terms, please do not use the Service or take out a subscription.
You confirm that you are of legal age (18 or over) and legally able to contract, or that you are acting with the consent and under the responsibility of a person holding parental authority.
Article 3. Description of the Service
Nanou Studio is a service that creates personalised stories for children. From the elements you provide (first name, photo, theme, casting), artificial intelligence models generate an original text, a cover illustration, scene-by-scene illustrations and audio narration. The stories created are available from your account and playable from the app.
The Service is intended strictly for private, family, non-commercial use.
Article 4. User account
Using the Service requires creating a personal account. You warrant that the information given at sign-up is accurate and you undertake to keep it up to date. You alone are responsible for the confidentiality of your credentials and for any activity carried out from your account.
The account is personal and non-transferable. Selling or sharing it with a third party is prohibited, except where a specific subscription plan explicitly allows sharing (for example via a co-subscription platform like Spliiit, when that option is open).
You can delete your account at any time from the app. Deletion triggers permanent erasure of the associated data, under the conditions set out in the Privacy policy.
Article 5. Financial terms
5.1. Free tier
The Service offers a free access tier with a daily quota of 3 reads per day, no credit card and no commitment.
5.2. Subscriptions
To create new personalised stories you can subscribe to one of the paid plans offered by the Publisher (Solo, Duo, Studio). Current features and prices are described on the Pricing page. Subscriptions run for a monthly or yearly term, renewed tacitly on identical terms unless cancelled.
5.3. One-off purchases
The Publisher may also offer story packs sold individually or as a bundle, with no automatic renewal. The price shown at checkout is firm and final.
5.4. Payment
Payments are processed through your app store's billing platform (App Store, Google Play) or via our payment processor, in accordance with their terms. Prices are listed in euros, all taxes included.
5.5. Cancellation and right of withdrawal
You can cancel your subscription at any time from your account area or from the platform you subscribed through. Cancellation takes effect at the end of the current period, with no pro-rata refund.
Under article L. 221-28 of the French Consumer Code, you expressly waive your right of withdrawal for digital content delivered or downloaded immediately upon subscription, the supply of which begins with your express consent.
Article 6. Generated content and photos
6.1. AI-generated content
Stories are produced automatically by artificial intelligence models. The Publisher operates moderation filters designed to keep content suitable for children. You acknowledge nonetheless that these models can occasionally produce imperfect or unexpected results. Any inappropriate content can be reported from the menu on the story concerned.
6.2. Imported photos
If you import a photo (of your child, a relative or a pet) to turn it into a stylised portrait, you warrant that you have obtained the necessary consent from any identifiable person (including, where applicable, the other holder of parental authority). The original photo is not retained long-term and is deleted after transformation, under the conditions set out in the Privacy policy.
6.3. Shared stories
You may choose to make certain stories public within the community library. This sharing can be revoked at any time from the app. Stories flagged as private are never accessible to third parties.
Article 7. Intellectual property
The Service, its interface, source code, brand, logo and every element it comprises are the exclusive property of JL CAPITAL or its partners.
The stories you create through the Service are licensed to you for strictly personal, family, non-commercial use. You may read, listen to and share them within a private circle. Any commercial exploitation, public paid distribution, or use to train an artificial intelligence model is prohibited without prior written authorisation from the Publisher.
Article 8. User obligations
You undertake to:
- Use the Service in good faith and in line with its purpose;
- Refrain from circumventing moderation filters or generating inappropriate, unlawful, violent, hateful or sexual content;
- Not import any photo for which you have not obtained permission to use;
- Not attempt to access accounts or data that are not yours;
- Not use the Service for spam, fraud or any breach of IT security;
- Not reuse the generated content for commercial purposes.
Any breach may lead to immediate suspension or termination of your account, without prejudice to any legal action the Publisher may bring.
Article 9. Availability and liability
The Publisher takes reasonable steps to ensure the Service's availability, security and quality. The Service is, however, provided "as is", without any guarantee of permanent availability or total absence of defects. The Publisher may at any time interrupt the Service temporarily for maintenance or updates.
The Publisher's liability is limited to direct, foreseeable damages caused exclusively by its fault. Indirect damages, loss of data and loss of opportunity are excluded. Where you act as a consumer, the mandatory provisions of the French Consumer Code and Civil Code remain applicable.
Article 10. Suspension and termination
The Publisher reserves the right to suspend or terminate your access to the Service in the event of a material breach of these Terms, after a formal notice that has remained unaddressed for eight (8) days, except in cases of urgency justified by the protection of other users or minors.
You may terminate your account at any time, without reason, from the app.
Article 11. Personal data
The processing of personal data is described in detail in the Privacy policy. JL CAPITAL acts as data controller within the meaning of Regulation (EU) 2016/679 (GDPR).
Article 12. Changes to the Terms
The Publisher may change these Terms at any time. Any material change will be notified to you by email or via an in-app notification with reasonable notice. Continued use of the Service after that notification constitutes acceptance of the new Terms.
Article 13. Mediation and dispute resolution
In the event of a dispute, please contact our customer service via our contact form to seek an amicable resolution. Failing agreement, you may freely refer the matter to a consumer mediator in accordance with articles L. 612-1 et seq. of the French Consumer Code, or to the European online dispute resolution platform: ec.europa.eu/consumers/odr.
Article 14. Governing law and jurisdiction
These Terms are governed by French law. Failing amicable resolution, any dispute will be brought before the competent French courts, in line with the jurisdiction rules applicable to consumers.
